Terms and conditions of sale

Orders

  • Orders must beplaced in writing (by email), stating the product referencesand quantities.
  • Once confirmed by Carima, orders are considered binding.
  • In the event of subsequent cancellation by the customer, the customershall bear any loss and damages caused to Carima, including any expensesincurred by Carima.

Prices

  • Prices are net (after discount),Ex Works (ex worksSpain)and do notinclude VAT. It is the customer’s responsibility to bear all costs related totransport, insurance, customs and other formalities.
  • Carima reserves the right to change prices with2 months’ noticeprior tothe placing of the corresponding order if raw material costs change.

Delivery and Installation

  • Deliveries are made in accordance with Incoterms Ex Works (2000);therefore, unless otherwise agreed, the transport costs and risks are borneby the customer.
  • If Carima is responsible for transport and installation, installation by qualified technicians is essential to guarantee safety. The customer mustprovide access and the necessary conditions for the installation to becarried out correctly.
  • As many pieces of equipment are made to measure, customised installations cannot be returned or refunded.
  • Carima will not be liable for any damage or malfunction arising frominstallations or uses that are unauthorised or not carried out by designatedprofessional personnel.

Payment Terms

  • In the first order payment is made in cash, understood as payment prior toor upon delivery, using the methods accepted by Carima (bank transfer orcard).
  • In subsequent transactions, and always subject to approval by the insurer,Carima may grant a term of 30 calendar days calculated from the invoiceissue date.
  • All products are delivered with retention of title, remaining the property of Carima until full payment has been made.

Warranty

  • Carima cranes and equipment: 3 years from the dispatch date.
  • Batteries and accumulators: 6 months from the date of dispatch, giventheir technical characteristics and limited service life.

Not covered:

  • Incorrect installationscarried out by third parties or improper use such as,for example, not keeping the cranes properly maintained or charged.
  • Handling, repair, modification or maintenance carried out by unauthorisedpersonnel or not following the manufacturer’s recommendations.
  • Damage caused by external agents or force majeure events such aselectrical discharges, flooding or other events beyond Carima’s control(such as vandalism, malicious acts, etc.).
  • Natural wear and tear, deterioration due to lack of maintenance or incorrectuse.

In the event of a confirmed manufacturing defect, Carima will repair or replace theproduct free of charge.

Returns

  • Under no circumstances will Carima accept returns of products inexchange for a refund of the price paid, unless all the followingrequirements are met:
    • The return must be made within one month following the date shownon the delivery note.
    • Returned products must be in perfect condition.
    • The products must not have been installed or put into service in anyfacility.
    • A copy of the delivery note must be enclosed with the products.
    • Slings: returns will only be accepted if they have not been openedand/or used, and are in their original packaging, closed and sealed.
  • In the event of non-compliance with the above requirements, Carimareserves the right to determine the applicable refund amount.
  • Carima also reserves the right to apply a 10% surcharge on the cost of thereturn to cover handling and restocking work.
  • The customer must request refunds from comercial@carimatech.com ,stating the order number and the reason for the return. The return shippingcosts are borne by the customer.
  • After verifying the condition, the refund will be made, where applicable,within a maximum period of 30 working days.

Delivery of Damaged Product

If, during delivery of the material, a visible defect or damage is detected, it must bereported within a maximum period of 24 hours to service@carimatech.com .Documentary evidence of the damage must beprovided.

For hidden defects that are not detected at the time of delivery, notification mustbe made within a maximum of 7 calendar days from receipt of the product.

A note must be included on the carrier’s delivery note.

Imagesor videos of the detected damage must be provided.

Training

Carima recommends under taking training at its facilities, provided by specialisedtechnicians, to ensure correct use of the hoists and proper maintenance of thebatteries.

Jurisdiction

For any dispute, the customer expressly accepts the jurisdiction of the Courts and Tribunals of San Sebastián (Spain), which will have exclusive jurisdiction.
